If the shell is clean thats not a bad price for the trans stuff and a clean shell.

Sorry, but you don't have any recourse, it's a used car and even if you did bring it to court, you'd be looking at more time and money than what you're looking for. The court would simply say that you should've double checked to see that the part was on there. I'd even take $350 from him and call it a day. You can buy a used link for about that much and you're good to go. It looks like a nice car overall, you shouldn't have any problem getting your money out of it.

It's still a clean car for the most part right Brad? Why get rid of it then? I would take the $300-$350 or whatever and use that to buy link with. Do that and you are right where you started before you realized it didn't have it to start with. These things aren't getting any easier to find in good condition, so if you have a nice one, it would be a shame to see you ditch it just cause the seller is a pos. If you do decide to sell, there are a few nice Evo's out there :)
